Passage of Title, Shipping and Risk of Loss. Title to and ownership of your order passes from us to you in New York. You may arrange to pick up your order from our New York location by emailing us contact@fineliquors.com. If you choose to have your order shipped to the destination of your choosing, you hereby acknowledge that you understand and agree that you are authorizing us to act on your behalf as your agent in arranging for the transportation of your order at your direction. By choosing shipping as a delivery method and having us arrange the shipping on your behalf, you are representing, warranting and affirming that you are acting in compliance with the laws, codes, statutes and regulations of your State, municipality, county, city and any other local laws, codes, statutes and regulations and agency guidance that apply to you regarding the use of the Services and this Site, in particular, without limitation, the purchase, shipping, transportation, importation, and delivery of alcoholic beverages, including, without limitation, wine and/or distilled spirits.  You also represent, warrant and affirm that you have obtained any and all required permission and/or licenses, paid any required fees (including, without limitation, taxes), are working through properly licensed intermediaries where required, are at least 21 years of age, and are legally entitled to receive and take possession of alcoholic beverages. New York sales tax will be applied in all cases, except that we reserve the right to remit sales tax to the state to which your order is shipped. You are solely responsible for applicable local and state sales tax outside of New York.

 

      WE EXPRESSLY DISCLAIM ALL REPRESENTATIONS, WARRANTIES OR AFFIRMATIONS ABOUT THE LEGALITY OF SHIPPING YOUR ORDER, INCLUDING, WITHOUT LIMITATION, ALCOHOLIC BEVERAGES, WHETHER THROUGH A COMMON CARRIER OR OTHERWISE.

 

Unless otherwise indicated at the time of your purchase or otherwise by FINE LIQUORS, shipping and handling fees are included with your order. Shipping dates and/or arrival times are only estimates, and not all Services may be available for purchase or delivery in your area. If you fail to receive your order after the allocated number of attempts of delivery under the shipping agency’s policies, and the product is sent back to FINE LIQUORS, a ten (10%) percent restocking fee will be deducted from your refund. Shipping costs will not be refunded. If the package returned to FINE LIQUORS is damaged because of failed delivery attempts or refusal of delivery, you are responsible for the full cost of the order. We will adjust your transaction at our discretion. Repeated claims of undelivered items may result in the cancellation of your transaction, Account, and/or future orders.

 

Refunds, Returns and Exchanges. 

FINE LIQUORS DOES NOT OFFER REFUNDS OR RETURNS. If we decide, in our discretion, to make an exception, a twenty five (25%) percent restocking   fee will be deducted from your refund. Shipping costs will not be refunded. If   you have concerns or problems with the items you receive, please contact us   by email at contact@fineliquors.com or via the contact information on the Site   and we will attempt to resolve the issue in accordance with these Terms. We   reserve the right, in our sole discretion, to issue or not issue refunds or exchanges for returned items.

Exchanges and Store Credit are determined on a case-by-case basis. If your product was received significantly damaged, you may be eligible for an identical replacement, provided such product is in stock and you purchased shipping insurance from us at the time of checkout of the damaged product. In the event the product is no longer in stock, you may be eligible for a store credit (“Store Credit”) in the amount of the purchase price of the damaged item, including shipping costs.

If the product you received does not match the product on the receipt or invoice of your order, we will ship you the correct item that matches your receipt or invoice, upon our receipt of such item via the return label we provide to you. If the item is no longer in stock, we will issue you Store Credit in the amount of the purchase price of the incorrect item.
